Environmental Impact Assessment (“EIA”) is a multi-disciplinary tool that is used to assess the environmental and socio-economic related consequences of projects, plans or policies. EIA is a decision-making instrument and its main goal is to minimize the negative impacts of industrial projects on the environment. As a signatory to the Rio Declaration on Environment and Development, 1992 (“Rio Declaration”), India is duty-bound to the international community to undertake an EIA for any proposed project. The Ministry of Environment, Forests, and Climate Change (“MOEFCC”) is entrusted with the task of regulating such projects and has notified the process of obtaining environmental clearances and preparing EIA reports from time to time. The most recent draft of the EIA notification issued by the MOEFCC on March 23, 2020 (“2020 Notification Draft”) aims to ease many restrictions surrounding the said projects. Given the looming threat of global warming and climate change, the importance of environmental legislation and policy has come to the fore in the last few decades. In this background, the 2020 Notification Draft has come under fire for seeking to relax regulations at a time when the environment needs more protection than ever. This article will attempt to emphasize the importance of EIA rules and regulations and to deconstruct the problems with the 2020 Notification Draft. By shedding light on some of the disastrous events that have been induced by climate change and lax environmental protection, this article endeavors to remind the reader that environmental regulations and their enforcement requires immediate action and attention.
