Law is a very dynamic concept. It needs to change with the changing and developing society. With time, if no changes are brought in law, then it may start doing unjust with the society. It has been more than 150 years since when the provision of section 309 of IPC has been followed. This section criminalizes the act of attempt to suicide. It’s high time for us to realise the need of decriminalizing this provision. This paper talks about as to why we need to decriminalize this section, how other countries of the world deal with criminalizing this very act, what impact does this provision have on the person who attempts to suicide, and to what extent, the mental Health Care Act has brought changes.
